01 — Operator & Service Description

Kochi.co ("the Platform", "we", "us") is a city information portal operated by Gallivant Ventures LLP, a limited liability partnership registered in India.

Kochi.co aggregates and displays publicly available social media posts, news, civic information, and cultural content related to Kochi, Kerala. The Platform also publishes original editorial content through its own official social media handles. The Platform is accessible via the website at kochi.co and any associated mobile applications.

Kochi.co is not affiliated with the Kochi Municipal Corporation, the Government of Kerala, or any government body unless expressly stated. References to official information on the Platform are sourced from public domain sources and do not constitute official government communications.

02 — Acceptance of Terms

By accessing or using Kochi.co — whether through a web browser, mobile application, or any other means — you agree to be bound by these Terms & Conditions ("Terms"), our Privacy Policy, and any additional terms applicable to specific features of the Platform.

If you do not agree to these Terms, you must immediately cease use of the Platform.

These Terms constitute a legally binding agreement between you and Gallivant Ventures LLP under the laws of India, including the Information Technology Act, 2000 and its amendments.

03 — Eligibility

You may use Kochi.co if you are at least 13 years of age. By using the Platform, you represent that you meet this requirement.

If you are under 18 years of age, your use of Kochi.co is subject to the consent and supervision of a parent or legal guardian. We do not knowingly collect personal information from children under 13; see our Privacy Policy for details.

The Platform is accessible globally. Users outside India, including users in the Gulf region, the United Kingdom, Europe, and elsewhere, may access the Platform but do so subject to these Terms and Indian law. You are responsible for ensuring that your use of Kochi.co complies with the laws of your own jurisdiction.

04 — Intermediary Status

Kochi.co operates as an intermediary as defined under Section 2(1)(w) of the Information Technology Act, 2000 (India). In this capacity, we store and transmit third-party information but do not originate, initiate, select the receiver of, or modify the content of aggregated social media posts in their substance.

Gallivant Ventures LLP shall not be liable for third-party content hosted on the Platform, to the extent that such immunity is available under Section 79 of the Information Technology Act, 2000 and the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021, provided we act expeditiously to remove or disable access to content upon receiving actual knowledge of unlawful material.

Official Kochi.co content — posts published through our own handles (@kochi, @kochidotco) — is original content owned by Gallivant Ventures LLP and is not covered by intermediary protections.

05 — Third-Party Content

Kochi.co aggregates publicly available posts from social media accounts that have made their content public on Facebook, Instagram, X (Twitter), and YouTube. The following terms apply to all such content:

• Accuracy: We make no representation that aggregated content is accurate, current, complete, or suitable for any purpose. Social media content is reproduced as-is from the originating account. Errors, outdated information, and factual inaccuracies may appear.
• No endorsement: The appearance of a post, account, or organisation on Kochi.co does not constitute an endorsement, recommendation, or verification by Gallivant Ventures LLP.
• Platform terms continue to apply: Content sourced from Facebook, Instagram, X, and YouTube remains subject to those platforms' own terms of service. Your interaction with embedded or linked content on those platforms is governed by their respective terms.
• Opinions and views: Third-party content may express opinions that do not reflect the views of Kochi.co or Gallivant Ventures LLP. We do not verify the credentials, authority, or accuracy of third-party posters.
• News and civic information: Content categorised as "City News" or "Government" is sourced from public social media accounts. It does not constitute official government communications. For official notifications, refer to the relevant government authority directly.
• Weather data: Live weather information on Kochi.co is sourced from Open-Meteo. It is provided for general informational purposes only and must not be relied upon for safety-critical decisions. We accept no liability for errors in weather data.

06 — Intellectual Property

Kochi.co brand and original content

The Kochi.co name, wordmark, tagline ("The world was always here."), visual identity system, design, layout, original editorial text, and software are owned by or licensed to Gallivant Ventures LLP. All rights are reserved. You may not reproduce, modify, distribute, or create derivative works from any Kochi.co brand or original content without prior written permission from Gallivant Ventures LLP.

Third-party content

Social media posts displayed on the Platform remain the intellectual property of their original creators and are subject to the terms of the originating platform. Kochi.co displays such content pursuant to the public APIs and embed mechanisms provided by those platforms. We do not claim ownership over any third-party post.

Platform logos

Logos and trademarks of Facebook, Instagram, X, and YouTube are the property of their respective owners and are used on Kochi.co solely to identify content sourced from those platforms, in accordance with each platform's brand guidelines.

Permitted personal use

You may share links to Kochi.co pages and embed Kochi.co content for personal, non-commercial purposes with attribution to Kochi.co. Any commercial use, scraping, bulk download, or republication of content requires prior written consent from Gallivant Ventures LLP.

07 — Permitted Use

Subject to these Terms, Gallivant Ventures LLP grants you a limited, non-exclusive, non-transferable, revocable licence to access and use Kochi.co for personal, non-commercial purposes.

Permitted uses include:

• Browsing aggregated social media content and news related to Kochi
• Sharing links to Kochi.co pages on social media or messaging platforms
• Using the Platform as a reference for publicly available information about Kochi
• Embedding individual content widgets where Kochi.co provides official embed functionality

08 — Prohibited Conduct

You must not use Kochi.co to:

• Scrape, crawl, spider, or systematically download content from the Platform without written permission
• Reverse engineer, decompile, or disassemble any part of the Platform's software
• Circumvent, disable, or interfere with security features of the Platform
• Use automated tools to access the Platform in a manner that exceeds normal human usage
• Republish, resell, or commercialise content from the Platform without prior written consent
• Submit false, misleading, or fraudulent takedown requests or grievance reports
• Attempt to impersonate Kochi.co, Gallivant Ventures LLP, or any official @kochi handle
• Use the Platform in any way that violates applicable Indian law or the laws of your jurisdiction
• Transmit malware, viruses, or other malicious code through the Platform

Violations may result in termination of your access to the Platform, and where applicable, referral to law enforcement authorities.

09 — Third-Party Services

Kochi.co integrates with third-party services to deliver its functionality. Your use of those services is subject to their own terms of service and privacy policies.

Kochi.co may include links to external websites. We are not responsible for the content, accuracy, or practices of linked third-party sites. The inclusion of a link does not constitute endorsement.

10 — Disclaimers

To the fullest extent permitted by applicable law, Gallivant Ventures LLP disclaims all warranties, including but not limited to:

• Accuracy: We do not warrant that any content on Kochi.co — including aggregated social media posts, news summaries, civic information, or weather data — is accurate, complete, current, or error-free.
• Availability: We do not guarantee that the Platform will be available at all times, uninterrupted, or free from technical errors. Planned and unplanned maintenance may cause downtime.
• Fitness for purpose: Content on Kochi.co is provided for general informational purposes only. Nothing on the Platform constitutes professional, legal, medical, financial, governmental, or safety advice.
• Third-party content: We make no warranties regarding the accuracy, legality, or appropriateness of content posted by third parties and aggregated by the Platform.
• Weather data: Weather information sourced from Open-Meteo is provided for general awareness only. Do not rely on it for emergency planning, travel decisions, or safety-critical purposes.
• NRI and diaspora information: Content relating to travel, flights, immigration, or Gulf-India connections is aggregated from public sources. Always verify such information with the relevant airline, embassy, or authority before acting on it.

11 — Limitation of Liability

To the maximum extent permitted by applicable Indian law, Gallivant Ventures LLP, its partners, employees, and affiliates shall not be liable for:

• Any indirect, incidental, special, consequential, or punitive damages arising from your use of the Platform
• Loss of data, revenue, profits, or business opportunities arising from Platform downtime or content errors
• Damages arising from your reliance on third-party content aggregated on the Platform
• Damages arising from your interaction with third-party platforms or services linked from Kochi.co
• Actions of third parties whose content appears on the Platform

Where liability cannot be excluded entirely under applicable law, our total aggregate liability to you for all claims arising from these Terms or your use of the Platform shall not exceed the greater of (a) the amount you paid us, if any, in the 12 months preceding the claim, or (b) INR 1,000.

Nothing in these Terms limits liability for fraud, wilful misconduct, or any other liability that cannot be excluded by law.

12 — Indemnification

You agree to indemnify, defend, and hold harmless Gallivant Ventures LLP and its partners, officers, employees, and agents from and against any claims, liabilities, damages, losses, and expenses — including reasonable legal fees — arising out of or in connection with:

• Your breach of these Terms
• Your violation of any applicable law or the rights of any third party
• Any content you submit, transmit, or post in connection with the Platform
• Any false or misleading takedown request or grievance report you submit

13 — Grievance Officer

In accordance with the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021, Kochi.co has designated a Grievance Officer to receive and address complaints and reports from users.

The Grievance Officer will acknowledge your complaint within 24 hours and resolve it within 15 days of receipt. Complaints related to content that violates Indian law, including content relating to the sovereignty or integrity of India, State security, or public order, will be acted upon within 72 hours of receipt.

If you are not satisfied with the resolution, you may escalate your complaint to the Data Protection Board of India (for privacy-related matters) or approach appropriate judicial authorities.

14 — Content Takedown Requests

If you believe that content appearing on Kochi.co infringes your intellectual property rights, violates applicable law, or contains your personal information that you wish to have removed, you may submit a takedown request.

Fastest method: Delete the original post from the source platform (Facebook, Instagram, X, or YouTube). It will be removed from the Kochi.co feed within 24 hours as our aggregation cache refreshes.

Direct request: Email follow@kochi.co with the subject line "Content Takedown Request" and include:

• The URL or description of the content you wish to have removed
• A link to the original post on the source platform (if applicable)
• The reason for the removal request (legal violation, personal data, copyright, etc.)
• Your name and contact information

We will acknowledge your request within 24 hours and action it within 15 days (or within 72 hours for matters involving public order or national security under applicable Indian law).

Submitting a false, misleading, or bad-faith takedown request is a violation of these Terms and may expose you to legal liability.

15 — Governing Law & Dispute Resolution

These Terms are governed by and construed in accordance with the laws of India, including the Information Technology Act, 2000, the Digital Personal Data Protection Act, 2023, and applicable rules and regulations thereunder.

Any dispute, claim, or controversy arising out of or in connection with these Terms, including disputes relating to their validity, interpretation, breach, or termination, shall be subject to the exclusive jurisdiction of the courts located in Kochi, Kerala, India.

Users accessing Kochi.co from outside India agree that Indian law governs their use of the Platform and consent to the jurisdiction of the Kochi courts for any dispute.

Dispute resolution: Before initiating formal proceedings, we encourage you to contact us at follow@kochi.co to attempt an informal resolution. We will endeavour to respond within 15 business days.

16 — Changes to These Terms

Gallivant Ventures LLP reserves the right to modify these Terms at any time. When we make material changes, we will:

• Update the "Last updated" date at the top of this page
• Post a notice on the Platform or through our official social media handles where the change is significant

Your continued use of Kochi.co after the effective date of any changes constitutes your acceptance of the revised Terms. If you do not agree to the revised Terms, you must discontinue use of the Platform.

We recommend reviewing these Terms periodically. The current version is always available at kochi.co/terms-and-conditions.
